Since May 2019, Royal Decree-law 8/2019 has required all companies in Spain to record daily working hours for every employee, including start and end times. This applies to any mechanical workshop with employees, regardless of size. Non-compliance can result in fines ranging from €626 to €6,250 per infringement.
What the working hours log must include
- Start and end time for each employee, every day.
- Records must be kept for a minimum of 4 years and be available to employees, their representatives and the Labour Inspection on request.
- The log must be reliable — it cannot be altered retrospectively without leaving a trace. A spreadsheet anyone can freely edit may not be accepted as valid during an inspection.
- Overtime worked must be reflected in the log and communicated to the employee monthly.
Why paper and spreadsheets may not be enough
The law does not specify a format but requires the log to be "organised and accessible." A paper signing book can be lost or damaged. A shared spreadsheet can be modified without leaving a trace. In an inspection, the Labour Authority may question the validity of a record that offers no integrity guarantees.
